I wonder if anyone could give me some advise please !

I have a project that had council approved plans and building had therefor begun on site. One of the nieghbors has subsaquintly decided he wanted to give the project a hard time and called apron NEMA approval and is threatening to issue a stop works.

Here is the question , Why was it not flagged at council approval stage that a NEMA approval would be necessary , and can you issue a stop works seeing that all the plans had been through and approved by all devisions of council, including environmental ?


Your advise would be very much appreciated !

If you project is a listed activity with a trigger table in the Act (nema). But you don't trgger any of these trigger pionts or your volumes is way under these. Do you still need a letter from the department stating this fact. Which is clear from just reading the act. If the letter is necessary who is responsible to obtian it, the local authority or project originators.

No it is illegal for any municipailty to give approval without a NEMA/EIA approval and full public participation process.

Hi Trevor, it is illegal for ANY building operations to begin without the proper Environmental Authorisations. Unfortunately a lot of developers get very cock sure and start building thinking they have their environmental authorisation in the hat already. A number of developers in the past have had to demolish structures and revegetate damaged ecosystems due to their stupidity. Report this matter to the Dept of Environmental Affairs.

There is a property less then 100 meters from the sea high water mark.which has had plans passed for a 3 storie block of flats.NEMA approval is a prerequisit.Can building start before Nema approval ? When is a building started ,when excavations begin or when foundations are poured. I would understand that building begins when excatavions begin,can you please advise.

Hi, My property is about 100 m away from a small wetland. Ethewini Municipality is taking 75% for a conservation zone.They are not prepared to give a rates rebate or pay for my land. It is fenced and mowed and I have pets and chickens. I also had plans to build a granny flat for my parents who can not afford a retiremnet home which I am now not allowed to do on my own property. Anyone with advice on how to stop this.

Hi, pls help. my parents were having a piece of a land which was used for farming.they did stop farming some years ago ,could be a decate ago but now the MINE(twickennam mine at burgerfort) approach the chief at our village and request the land and the chief did give them the land without speaking with my parent about the land resoan being we are not using the land. I really need help in this matter coz i feel sad everytime i take a look at the place my parents used farm. I believe that we have authority to decide and know abt the land, not to be told abt the land. pls help. Mine are robbing old ppl at villages.

Somebody help us, we live in an old home settlement in the north of Durban next to Ballito in a place called Shakashead. The houses we live in are old and dibilitated with old sewerage tanks that are not serviced and mantained. We were promised upgrading of these facclities in 2004 unfortunately this has not been the case. Sewerage is running raw in between our houses and we have no proper toilet structures in place its a stinky place that makes children sick. We are a poor community that is suppressed and would welcome anyone willing to help us and our children living in these conditions. Plz♣ give us direction as we are unable to persuade the local structure to act on this matter. Thank you we welcome any suggestion and intervention that may help alleviate this situation.
