The Protection of Information Bill is a new piece of legislation currently being deliberated by parliament. Already there are many voices of opposition to this bill, specifically from the South Africa media as a bill of this nature effectively gives the ruling party the power to deem anything they like "unfit" for public consumption. What's striking though is the fact that, once again,  few (if any at all) normal citizens have written any comments of opposition. Like with other legislation ushered through parliament in recent years, the general public do diddly squat when they have a chance to oppose or comment and then once the bill is passed and it starts affecting their lives then they start complaining.

More South African's need to download, read and write comments to this piece of legislation. Do NOT leave it up to a few people who are not paid, overworked and stressed to deal with all this stuff. Get out of your armchair and do something for the greater good.

Information Bill like 'apartheid-era legislation':
"Sections of the government's proposed protection of information legislation are reminiscent of apartheid-era secrecy laws, according to an intelligence expert. They also displayed a fundamental misunderstanding of the Constitution, Dr Laurie Nathan said in a submission to Parliament's ad-hoc committee on the Protection of Information Bill." full article

The  Protection of Information Bill  causes protests in South Africa:
"As the excitement of the World Cup dies down, the South African media fades back into the familiar territory of fighting for freedom of speech. The African National Congress (ANC) is currently in the process of passing a couple of new pieces of legislation which appear antithetical to freedom of the press. The first being the Protection of Information Bill, in which there are relatively low standards for protecting what journalist are allowed to publish. Information such as commercial governmental contracts, state-owned enterprise and state entities are considered classified under the Protection of information. If the bill passes, journalist who violate the this law could spend up to 25 years in jail. The second is the announcement that a "media tribunal" will oversee the general media to stop "unfair" criticism." full article

Protection of Information Bill threatens media freedom:
"PRETORIA, South Africa, July 23, 2010/African Press Organization (APO)/ — Lawmakers were warned again on 22 July 2010 that the Protection of Information Bill would not survive Constitutional Court scrutiny because it rides roughshod over media freedom and the democratic values of transparency and accountability. Dario Milo, a partner at Webber Wentzel law firm, making a presentation on behalf of Print Media South Africa, said during his address to the Parliamentary committee that the bill which is meant to replace an apartheid-era law dating from 1982 could see investigative journalists face up to 25 years in jail for publishing information of public interest." full article

Protection of Information Bill, a story about a special kind of divorce:
"As any divorcee will tell you, falling out of love sucks. You understand that life as you know it is about to come to an end. It is how most journalists feel when they read the proposed Protection of Information Bill. So we have to ask, how did it come to this? How did it happen? The fact is that many journalists will tell you it’s come as quite a surprise to find that this draft is so much worse, so much more draconian than the one that emerged during the Mbeki era. Since Polokwane, there’s been much more political openness, much more of a role for the press, and simply much more interaction between the media and politicians. President Jacob Zuma’s ANC administration has been about charming the pants off the media, rather than trying to shut it up. Think of Mathews Phosa vs Mendi Msimang, or Gwede Mantashe as opposed to Kgalema Motlanthe as the secretary general. When it comes to media profile, there’s no contest, the new guys were happier to be in the spotlight. Even Zuma himself, despite his rather rough ride over his legal difficulties, has worked pretty hard at it." full article

Herewith is all the latest documents and legislation relating to Environmental Impact Assessments in South Africa.

Those involved in the environmental law industry should update themselves with this latest info.

Regular citizens should also read this documentation to be aware of the processes and regulations especially if they find themselves taking part in an Environmental Impact Assessment for a development threatening their area. There have been numerous and ongoing attempts by private Environmental Law Firms and well as Government bodies to run roughshod over these laws and to rely on the public's lack of knowledge to speed up and manipulate these processes. Knowing what procedures must and must not be followed is very important as when it comes to final Records of Decision (ROD's) being issued, transgressions of these laws reported by registered parties can cause a major obstruction for the developer concerned and can lead to a Negative Record of Decision. The more people that know these laws the better because it keeps closing the gap on those who are paid hansomely by developers to get Speedy Environmental Approvals.

These documents are provided by government departments and are available to everyone free of charge.
Nobody may charge you a fee for these documents unless it is a printed version and they charge you ONLY for their printing costs.

REVIEW OF DRAFT ENVIRONMENTAL IMPACT ASSESSMENT REPORT

EXTENSION OF COMMENT PERIOD

 

As previously announced, an opportunity to review the Draft Environmental Impact Report (EIR) commenced on 06 March 2010 with a revised closing date of 31 May 2010.

 

Please be advised that the comment period has been further extended by an additional 30 days and the closing date for comment is now 30 June 2010 (117 days). You are, therefore, afforded the opportunity to use the extended period to further review the report and submit any additional comments.

 

Once the comments have been received a Revised Draft EIR, including its specialist studies, will be produced and placed at public venues for a further comment period of 45 days.

 

On behalf of the EIA Project Team, I should like to thank all those who have attended public meetings and Key Stakeholder Feedback Meetings held during the period 23 March – 25 May 2010, those who have already submitted comments on the Draft EIA Report and those who will take further time to review the reports and submit comments.

Biodiverse grassland, biofuels and bioliquids
Consultation period: 14/12/2009 - 08/02/2010


The sustainability requirements of the Directive 2009/28/EC on the promotion of the use of energy from renewable sources establish that raw materials used for the production of biofuels and bioliquids may not be produced on land that had the status of highly biodiverse grassland in or after January 2008. The objective of the consultation is to seek views on possible approaches to define the criteria and ranges of highly biodiverse grasslands. This will feed into the drafting of a Commission Decision on the establishment of criteria and ranges of highly biodiverse grasslands for the purpose of Directive 2009/28/EC.

The Commission is required to establish such criteria and ranges according to Article 17(3)c of the Directive 2009/28/EC .
(There is a similar requirement, as far as biofuels are concerned, in the Fuel Quality Directive [98/70/EC])

RE: ENVIRONMENTAL IMPACT ASSESSMENT FOR THE CONSTRUCTION OF A 40 MW OPEN CYCLE GAS TURBINE AND ADDITIONAL INFRASTRUCTURE IN THE AMERSFOORT AREA, MPUMALANGA PROVINCE

As previously communicated to you, Bohlweki-SSI Environmental has been appointed by Eskom Holdings as an independent Environmental Assessment Practitioner (EAP) to undertake the required Environmental Impact Assessment process as well as Water Use License Application for the above project.

During the 30 day public review period of the Draft Environmental Scoping Report (ESR) which took place from 12 October 2009 to 12 November 2009, Eskom’s design engineers informed the project team that
they might have to consider running a 140 MW gas turbine instead of a 40MW machine as it is better suited to the lower energy value of the UCG syn-gas Eskom produces.

Therefore, Eskom requested Bohlweki-SSI Environmental to amend the scope of work to consider a 40MW to 140MW plant during the EIA. The aforementioned as well as confirmation that the site footprint
will not be extended as a result of this change was communicated to all specialists which indicated that the recommendations and findings contained in their initial specialist reports undertaken will not be
affected.

In addition, it was also determined during the Draft ESR public participation process that a Health Impact Assessment (HIA) as well as Environmental Resource Economical (ERE) Study are required as part of the EIA process.

In light of the above, please note that a Draft Final ESR and Plan of Study for EIA have been amended to incorporate the recent project developments. Bohlweki-SSI Environmental has accordingly decided to
provide Interested and Affected Parties and Authorities with an extended commenting period until 4 December 2009 to provide inputs on the Draft Final report.

Copies of the amended report will be available on the websites of Bohlweki–SSI Environmental (www.bohlweki.co.za) and Eskom website (www.eskom.co.za).

Please submit your written comments on the Draft final ESR by no later than 4 December 2009 to Bohlweki-SSI Environmental.

In line with Parliament’s objective of providing a national forum for public consideration of issues and seeking to act as a voice of the people, the Parliamentary Portfolio Committee on Water Affairs and Forestry invites interested individuals and organisations to submit written submissions on Water Quality and Pollution challenges facing South Africa. This is in line with South Africa’s recognition of the need to monitor and assess the quality of water to determine the suitability for use and support of the management of water resources.

The public hearings are scheduled for Tuesday, 3 June and Wednesday, 4 June 2008 in Parliament.
